IMPORTANT NOTICE REGARDING YOUR CONSUMER RIGHTS

The benefits we give in this manufacturer's warranty are additional to and do not exclude the consumer guarantees that you may have under the Australian Consumer Law, as set out in Schedule 2 of the Competition and Consumer Act 2010 (“Australian Consumer Law”) or the New Zealand Consumer Guarantees Act 1993 (“CGA”) (as applicable) and other applicable consumer protection laws in Australia and New Zealand.

This manufacturer’s warranty is governed by the laws of the country in which you purchased your Linksys product.

In Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service, and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

In New Zealand, our goods come with guarantees that cannot be excluded under the CGA.

This manufacturer's warranty is not intended to:

  • change or exclude any rights under the applicable consumer law that cannot be lawfully changed or excluded; or
  • limit or exclude any right you have against the person who sold the Linksys product to you if that person has breached their sales contract with you.

Will the Product Warranty always apply?

This Product Warranty does not apply if:

  • the warranty claim was made fraudulently or by misrepresentation;

  • the product has been subjected to abnormal use, including but not limited to:
    • physical or electrical stress, misuse, neglect, or accident;
    • disassembly, alterations to the hardware or supporting setting files, service or repair or maintenance by other than Linksys authorized technicians;
    • external causes such as, but not limited to, natural disasters, water damage, extreme thermal or environmental conditions;

  • the serial number on the product has been altered, defaced, or removed;

  • any defects caused by transportation or loading during the returning voyage;
  • any defects you knew of or were made aware of before you bought the products; and
  • any other defects that are not caused by workmanship or product quality.

This warranty is only valid and enforceable in the country of purchase.

Note: Although this warranty doesn’t apply in these situations, you may have additional rights under local consumer laws in the country of purchase.

How will Linksys make things right?

If you make an eligible claim under this warranty, Linksys will, at its election:

  • repair the product with new or refurbished parts, or pay the reasonable costs of repairing the product;
  • replace the product with a reasonably available equivalent new Linksys product; or
  • refund you the purchase price of the product, minus any rebates and discounts.

Products presented for repair may be replaced by refurbished goods of the same type rather than being repaired.  Refurbished parts may be used to repair the goods.

Any replacement products are warranted for the Warranty Period. All products and parts that are replaced become the property of Linksys.

Note: The rights and remedies outlined above are the only rights and remedies available under this warranty. However, you may have additional rights under local consumer laws in the country of purchase.

General Exclusions and Limitations of Liability

For persons who purchased the product in Australia, if a supply under this warranty is a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, nothing contained in this warranty excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law, provided that, other than as expressly provided under the Product Warranty, to the extent that the Australian Consumer Law permits Linksys to limit its liability, then Linksys' liability shall be limited to:

  • in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
  • in the case of goods, replacing the goods, supplying equivalent goods, or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.

For persons who purchased the product in New Zealand, if a supply under this warranty is a supply of goods or services to a consumer within the meaning of the CGA, nothing contained in this warranty excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the CGA, except in relation to any rights and remedies that you may have under the CGA (which remain unaffected) and other than as expressly provided under the Product Warranty, Linksys' liability shall be limited to:

  • in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
  • in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods, or having the goods repaired.

Other than as expressly provided under the Product Warranty, and subject to the above provision in relation to the Australian Consumer Law and any rights and remedies that you may have under the CGA as, to the full extent permitted by law, Linksys:

  • excludes all other conditions, guarantees, rights, remedies, liabilities, representations, warranties, and other implied or express terms, conferred by statute, custom, or the general law that impose any liability or obligation on Linksys, including but not limited to any implied warranties of non-infringement, loss of or damage to data, lack of viruses or free from virus or malware attack, security, performance, lack of negligence, workmanlike effort, that the functions contained in the product will meet your requirements, or that defects in the product will be corrected, or that your use of the product will generate accurate, reliable, timely results, information, material or data;

  • excludes all liability for the loss of, or damage to, data caused by the use of a Linksys product, or its repair;

  • excludes any liability it may have to you for:
    • loss of revenue or profit,
    • loss of the ability to use any third-party products, software, or services, and

  • any indirect, consequential, special, incidental, or punitive loss or damages (including but not limited to loss of use, data, business interruption or cost of procuring substitute services), which arises under any law (including the law of negligence) and relates to your use, or inability to use a Linksys product or software, or any related services. This exclusion applies even if Linksys has been advised of the possibility of such damages and even if any warranty or remedy provided under this manufacturer's warranty fails of its essential purpose; and

  • limits its monetary liability to you, under any law, to the price that you paid for the Linksys product.

References in this Section to “indirect, consequential, special or incidental losses" shall mean any losses which (i) were not reasonably foreseeable by both parties, and/or (ii) were known to you but not to Linksys and/or (iii) were reasonably foreseeable by both parties but could have been reasonably prevented by you such as, for example (but without limitation), losses caused by viruses, Trojans or other malicious programs, or loss of or damage to your data.

These terms are the terms of the Product Warranty.

If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

Note: The general exclusions and limitations of liability outlined above do not affect any rights you may have under local consumer laws in the country of purchase.

Linksys may also install software updates as part of the warranty service.
